WOBURN, Mass. (AP) — The family of a 15-year-old Tewksbury boy found dead in Lowell in 1969 has filed a wrongful death lawsuit against three men who were charged with playing a role in the death.
A lawyer representing the family of John McCabe tells The Sun of Lowell (http://bit.ly/1lIYV9K ) that he filed the suit Wednesday in Middlesex Superior Court. The suit seeks $10 million.
Walter Shelley, of Tewksbury, Michael Ferreira, of Salem, N.H., and Edward Alan Brown, of Londonderry, N.H., were named as defendants.
No one was charged in connection with the death until 2011.
Prosecutors say the men, then teens, kidnapped, beat and bound McCabe after a dance because he had flirted with Shelley's girlfriend.
Shelley was convicted of murder last year. Ferreira was acquitted of murder. Brown pleaded guilty to manslaughter.
