Sandwich seeks to have ex-student's suit dismissedAP , Associated Press

SANDWICH, Mass. (AP) — Town lawyers have asked a judge to dismiss a $1 million federal civil rights lawsuit brought by a former Sandwich High School football player who was exonerated in court of assaulting a freshman teammate.
Ty McGrath and his mother sued the town, police and school officials over the 2011 locker room incident when McGrath was a senior. Their lawsuit says a 10-day suspension he received ended his high school playing career early, caused colleges to stop recruiting him, and caused emotional distress, including a suicide attempt.
McGrath was acquitted in court.
The Cape Cod Times (http://bit.ly/18Cw9To ) reports that town lawyers in their motion to dismiss say McGrath was never denied his due process rights and was given ample opportunity to appeal his suspension.
A hearing is scheduled for Jan. 30.
